General Terms and Conditions of the DOLPHINSWIM Institute
Before you book one of our programmes, you should take time to read these lines, as they are part of the contract concluded with us. The terms and conditions regulate the procedure, payments and liability. The scope of services of the Alpha Therapy can be found on the homepage www.dolphinswim.net or in the respective valid brochure.
Conclusion of the participation contract
1.1 With your registration on the basis of our brochures, you offer us the binding conclusion of the participation contract. The contract is concluded with the acceptance of the registration by us in Vienna. The registration takes place via the Alpha-Therapy registration form (by post or email). We will inform you about the acceptance by sending you the registration confirmation/invoice. Upon payment of the registration fee of 20% of the therapy price, registration is complete. In order to participate in Alpha-Therapy, it is also necessary to send the child's current findings (if available), and in any case a doctor's confirmation of the child's ability to participate.
1.2 The data provided to us will be protected in accordance with the Austrian Data Protection Act.
1.3 Please inform us immediately if you, as the applicant, have not received any feedback from us at the latest 3 days before the start of the journey (or the start of the therapy). In this case, we will immediately resend the documents, provided that you have paid.
2.1 With registration the registration fee has to be paid within 1 week. The premium for the cancellation insurance (if you wish to take out such insurance) is also due with the deposit. The final payment is due 31 days before the start of therapy without further request.
2.2 If we are unable to confirm your therapy registration, we will immediately refund any deposit you may have already paid.
2.3 If the agreed therapy price has not been paid in full by the start of therapy, this entitles us to dissolve the participation contract and to charge damages in the amount of the corresponding cancellation fees.
2.4 In the case of international transfers, the applicant shall pay half of the transfer fees.
3.1 The service descriptions in our brochure or on the homepage www.dolphinswim.net, as they have become the basis of the contract, as well as the information in the therapy documents and safety instructions referring to them, are binding for the scope of the contractual services.
3.2 Alpha therapy begins and ends - depending on your booked length of stay - on the therapy dates advertised on the homepage (the arrival and departure dates are for your information only for flight booking).
Changes in services and prices
4.1 We are entitled to make unilateral changes to the services provided that they are objectively justified and are minor changes that do not affect the price. The therapists reserve the right to cancel therapy sessions if this is necessary for medical, psychological (excessive demands on the child) or technical reasons (bad weather).
4.2 Changes or deviations of individual services from the agreed content of the participation contract, which should become necessary after conclusion of the contract, are only permitted insofar as the changes and deviations are not significant and do not impair the overall nature of the booked therapy/seminar. Any warranty claims shall remain unaffected insofar as the changed services are defective.
Cancellation, rebooking, substitute person
5.1 If you withdraw from the registration contract without appropriate reasons or if you do not take part in the therapy/seminar (e.g. due to missed flights, etc.), we can demand reasonable compensation for the arrangements made and our expenses. When calculating the compensation, we will usually take into account saved expenses and usually possible other uses of the services.
5.2 The amount depends on the therapy price. The cancellation fees that we have to charge per registered participant in the event of your withdrawal from the therapy are regulated as follows: The registration fee is non-refundable in the event of cancellation. Furthermore, cancellation fees must be calculated from the total amount of the therapy as follows:
- up to 30 days before the start of therapy 15%,
- from 29th to 20th day before start of therapy 25%,
- from the 19th to the 10th day before the start of therapy 50%,
- from the 9th to the 4th day before the start of therapy 65%,
- from the 3rd day (72 hours) before the start of therapy 85%.
5.3 If a substitute person takes the place of a registered participant, we are entitled to object to the change in the person of the participant if this person does not meet the special requirements with regard to the therapy or if legal regulations or official orders conflict with this.
Resignation by Dolphinswim
6.1 Dolphinswim is entitled to cancel the therapy. In the event of a cancellation, Dolphinswim is only liable for the therapy payments made and any travel cancellation expenses incurred. Any other damages cannot be claimed.
7.1 If the therapy is considerably impeded, endangered or impaired as a result of force majeure which was not foreseeable at the time of conclusion of the contract, both contracting parties may terminate the participation contract concluded.
8.1 Should a therapy not be provided or not be provided in accordance with the contract, you may demand remedy within a reasonable period of time. We are entitled to remedy the situation by providing a substitute service of equal or greater value. However, we may refuse to remedy the situation if this would require disproportionate effort. After the end of the therapy, you can claim a reduction of the travel price if the therapy was not provided in accordance with the contract and you did not culpably fail to report it on site. If a therapy is considerably impaired as a result of a defect and we do not provide a remedy within a reasonable period of time or no deadline needs to be set because remedy is impossible or is refused or the termination of the contract is justified by a special interest on your part, you may, in your own interest, preferably in writing, terminate the therapy within the framework of the statutory provisions.
8.2 In the event of any service disruptions, you are obliged to do everything within the scope of the statutory provisions to help remedy the disruption and to minimise any damage that may arise.
8.3 We accept no liability for the loss of or damage to valuables or money during therapy in cases of slight negligence.
9.1 Participation in Alpha Therapy is at the participant's own responsibility and discretion. In this context, the participant undertakes to take out travel health insurance.
9.2 Technical equipment abroad does not always correspond to Western European standards. Therefore, please be sure to observe any instructions for use.
10.1 All information in our brochures is published subject to legal or official approvals. Details of these prospectuses are as at the time of going to press.
10.2 With the publication of new brochures, all our previous publications about the same therapies or their dates and prices lose their validity (on our website - www.dolphinswim.net - the current version of our offers is available).
10.3 The invalidity of any part of these terms and conditions shall not affect the validity of the remaining provisions.
